This Terms of Service (hereinafter "Agreement") establishes the terms of use of the Digevent service — collection of photos, videos, and audio recordings from event guests via the Venue's local Wi-Fi or through the website digevent.org (hereinafter "Service").
By sending a file through the Service, you fully and unconditionally accept the terms of this Agreement. If you do not agree to the terms — do not use the Service.
The Service receives files submitted by a User, automatically assigns them to a specific Event at a specific Venue, and transmits them to that Venue's archive. The Service is provided "as is", without warranties of fitness for any particular purpose other than as described in this section.
4.1. The Content you submit remains yours; this Agreement does not transfer ownership to the Operator or the Venue.
4.2. By submitting Content through the Service, you grant the Operator and the Venue to whose archive the Content is assigned a non-exclusive royalty-free license to store, process, and display it within the archive of the corresponding Event.
4.3. Use of your Content for editing, publication on social media, promotion of future events, or other purposes beyond simple storage in the Event archive occurs only following a separate, voluntary coordination procedure with you and/or the Event's performers after its completion — this procedure is not covered by automatic acceptance of this Agreement upon file submission.
4.4. If the Venue offers a bonus token program for submitting Content, its terms (accrual rate, terms of use) are set by the Venue itself — the Service Operator does not guarantee or centrally regulate these conditions.
5.1. The Operator does not guarantee uninterrupted operation of the Service and is not liable for temporary unavailability caused by technical failures, infrastructure work (Cloudflare), or circumstances beyond reasonable control.
5.2. The Operator is not liable for the content of Content submitted by Users, or for use of Content by the Venue beyond simple archive storage (if such use occurred without proper coordination, the party that committed the violation is liable).
5.3. By sending a file, you yourself are responsible for complying with applicable law and the rights of third parties with respect to the Content you submit.
The parties seek to resolve disputes through negotiation. If resolution is not possible — disputes are resolved according to the law applicable to the Operator.
The parties are released from liability for failure to perform obligations if caused by circumstances beyond reasonable control: natural disasters, acts of government authorities, large-scale internet infrastructure failures, large-scale cyberattacks, and similar events that could not have been prevented by reasonable measures.
The Operator may make changes to this Agreement. The current version is always available at https://digevent.org/terms. Use of the Service after publication of a new version means agreement to the changes.
